  • Fatal Train-Truck Accident Wrongful Death Action: No Payment Following Master’s Hearing. Represented oil company owner of an oil delivery truck that stalled on train tracks at grade crossing resulting in catastrophic crash causing multiple deaths and multiple severe permanent burn injuries. Forty-nine day Master’s Hearing was followed by multi-million dollar settlement on behalf of co – defendants represented by other attorneys and no payment on behalf of client.
  • Medical Malpractice Action – Defendant’s Verdict: Represented psychiatrist in seventy-one day trial in action by multiple in-patients of psychiatric hospital alleging forced medication and involuntary seclusion. Court granted injunctive relief against co-defendant institution represented by other attorneys, thereby establishing new Massachusetts law as to patients’ rights. Court found in favor of client psychiatrist as to all claims against him.
  • Medical Malpractice Action – Defendant’s Verdict: Represented defendant surgeon in case where patient alleged that surgery performed was contra-indicated and caused severe abdominal scarring and pain.
  • Wrongful Death Action – Defendant’s Verdict: Represented restaurant chain in action claiming that design of parking lot entrance contributed to happening of fatal automobile accident.
  • Construction Accident Action – Defendant’s Verdict: Represented general contractor whose subcontractor installed “guillotine” overhead door in building at commercial construction site which fell without warning and amputated the toes on one of the plaintiff’s feet. Plaintiff presented medical testimony at trial that his leg should be amputated due to the impact of his injuries upon a pre-existing medical condition. Jury found in favor of client and against co-defendants represented by other attorneys, awarding plaintiff $500,000.
  • Dental Malpractice Actions – Defendants’ Verdicts: Have represented and won jury verdicts for multiple general dentists in actions involving a variety of allegations including failure to diagnose and treat periodontal disease resulting in bone loss and necessitating tooth extractions and extensive bridgework, negligence in extracting teeth causing numbness, and negligence in performing root canals which failed.
  • Oral Surgical Malpractice Actions – Defendants’ Verdicts: Have represented oral surgeons and won verdicts in their favor in numerous cases where plaintiffs claimed that tooth extractions and other oral surgical procedures had been improperly performed resulting in numbness, trismus, and permanent jaw pain due to TMJ.
  • Orthodontic Malpractice Action-Defendant’s Verdict: Jury returned verdict in favor of Board Certified Orthodontist and determined that all of his treatments of the plantiff had been in compliance with proper orthodontic practice.
  • Products Liability Action – Defendant’s Verdict: Represented manufacturer of mattress which caught fire and caused severe burns to plaintiff and the loss of several of her fingers. Jury determined that client was not responsible.
  • Products Liability Action – Summary Judgement: In favor of client owner of commercial building in case where plaintiff delivery person claimed to have sustained severe injuries in fall due to unsafe loading dock.
  • Products Liability Action – Summary Judgement: In favor of client condominium association in case where plaintiff tenant fractured hip in fall from exercise machine.
  • Products Liability Action – Defendant’s Verdict: Represented distributor of commercial roof cutting machine whose blade broke loose and impaled the skull of a factory worker in the room below. Plaintiff presented medical testimony that his life expectancy was severely shortened as a result of his injuries. Jury found in favor of client and against two co-defendants represented by other attorneys awarding plaintiff $1,000,000.
  • Slander-Libel Action – Summary Judgement: In favor of client, Mothers Against Drunk Driving (MADD, Inc.), in case involving allegations that plaintiff had been slandered and libeled by comments MADD representative made to media in connection with plaintiff’s arrest and conviction for driving under the influence of alcohol.
